Scott Kesterson on Boston, 1761: the writs of assistance allowed “search and seizure of goods in your home... without any warrant.”
WHAT THIS EPISODE COVERS
Rochelle Porto joins Scott Kesterson to trace the writs of assistance, the general search warrants British customs officers used in the colonies. They follow James Otis Jr. and the 1761 Boston case, the trade rules those writs enforced, and how a smuggling economy pushed colonists toward independence. They tie it to Adam Smith’s Wealth of Nations and ask what modern search and tracking tools share with the writs.
KEY QUESTIONS ADDRESSED
What were the writs of assistance, and why did they become a fight in 1761?
How did British trade rules and colonial smuggling build the case for independence?
What do today’s search and tracking tools share with a general search warrant?
